Terms of Service

Section 01

Acceptance of terms

By downloading, installing, accessing, or using the Donkey's Edge mobile application (the "App"), you agree to these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Donkey's Edge Analytics LLC, a Virginia limited liability company ("Donkey's Edge," "Company," "we," "us," or "our"). If you do not agree, do not use the App.

Section 02

Description of the service

Donkey's Edge provides poker equity calculators for Texas Hold'em and Omaha variants, range analysis, hand heatmaps, bankroll and session tools, player notes, and saved simulations. Features and availability may vary by platform, plan, region, and App version.

We may add, modify, suspend, or discontinue features when reasonably necessary to improve, maintain, secure, or operate the App.

Section 03

Account registration and security

Certain features require an account created with email and password, Google Sign-In, or Apple Sign-In. You agree to:

• Provide accurate and current account information
• Keep your password and sign-in credentials confidential
• Notify us promptly of suspected unauthorized access
• Accept responsibility for activity occurring through your account

You must be at least 13 years old to create an account. We may restrict, suspend, or terminate access where an account violates these Terms, threatens the service, or is used unlawfully.

Section 04

Free trial

Eligible new users receive a 30-day trial of premium features without providing payment information. After the trial, premium access is restricted unless you purchase a subscription. Trial eligibility is limited and may be denied where a prior trial has already been used.

Section 05

Subscriptions, billing, and cancellation

Plans and prices

Listed prices are in U.S. dollars and may vary by region, taxes, currency, store, or promotional offer. The price and terms displayed by Google Play or Apple at checkout control your purchase.

Billing and automatic renewal

Subscriptions are processed by Google Play on Android or the Apple App Store on iOS. Unless cancelled before the applicable renewal deadline, a subscription renews automatically for another billing period at the then-current price. Store terms govern billing timing and renewal.

Cancellation

You may cancel through the store account used to purchase the subscription:

• Android: Google Play Store → profile icon → Payments & subscriptions → Subscriptions
• iOS: Settings → your name → Subscriptions

Cancellation generally takes effect after the current paid period. Uninstalling the App or deleting your Donkey's Edge account does not cancel an active store subscription.

Refunds

Refund requests are handled by Google Play or Apple under the applicable store policy. Donkey's Edge Analytics LLC does not directly process store refunds.

Section 06

Acceptable use

You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in violation of applicable laws or regulations
• Attempt unauthorized access to the App, accounts, servers, or related systems
• Interfere with, overload, damage, or disrupt the App or its services
• Reverse engineer, decompile, or disassemble the App except where applicable law expressly permits it
• Use automated systems to access the service without permission
• Sell, resell, sublicense, or commercially exploit the App without authorization
• Manipulate or attempt to bypass subscription, trial, entitlement, or billing controls

Section 07

Intellectual property, user content, and backups

The App, including its software, design, branding, original content, features, and functionality, is owned by Donkey's Edge Analytics LLC or its licensors and is protected by applicable intellectual-property laws. These Terms provide a limited, revocable, non-exclusive, non-transferable right to use the App for its intended purpose; they do not transfer ownership of the App to you.

You retain ownership of content you create in the App, including bankroll records, player notes, images, and saved simulations. You authorize the App to process that content on your device as needed to provide requested features.

Section 08

Account deletion

You may delete your account from My Account in the App or follow the instructions on our Account Deletion page. Deletion removes your authentication account and associated cloud profile data, subject to limited legal or security retention described in our Privacy Policy.

Account deletion does not erase information stored only on your device and does not cancel an active Google Play or Apple subscription. Clear local app storage or uninstall the App to remove local data, and cancel your subscription separately through the applicable store.

Disclaimers and limitation of liability

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of this section may not apply to you.

Section 10

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Donkey's Edge Analytics LLC and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from your misuse of the App or violation of these Terms.

Section 11

Governing law and disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law provisions. Any dispute arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where applicable law does not permit mandatory arbitration.

Section 12

Changes to these terms

We may update these Terms to reflect changes to the App, our business, or legal requirements. If a change is material, we will provide notice through the App, by email, or through another reasonable method. The date at the top identifies the latest revision. Continued use after updated Terms take effect constitutes acceptance of the revised Terms.
